These types of cases can be charged as misdemeanors or felonies (as a “strike” or a non strike), can be domestic or involving a stranger, and may involve serious injuries or even none at all. These cases often turn on issues of credibility or states of mind before or during an altercation, and will often involve issues surrounding nuanced applications of bodies of law that have developed over centuries involving the right to self defense.
Today’s cases often have surveillance video and/or cellphone video captures that may take interactions out of context, or distort events leading up to altercations. Alcohol or drug consumption will also alter or affect perceptions and recollections of events. Romantic relationships and emotions can come into play as well, affecting indivual biases and animosities. These complexities must be investigated and explored to properly contextualize the encounter leading to charges.
